Standard Terms
1. Use and Misinterpretation of Services Provided
DigiCorpus Ltd. is not liable for any damages or losses that a buyer / third party may suffer as a result of the buyer's / third party's decisions or actions, that those of DigiCorpus ApS deliverables may form the basis of, or due to the buyer's / third party's misinterpretation of the DigiCorpus ApS deliverables.
2. Wrongful Instructions and Similar
DigiCorpus Ltd. is not liable for any damages or losses a buyer / third party may suffer as a result of incorrect information provided by DigiCorpus Limited, unless the buyer / third party can prove DigiCorpus Ltd. guilty of gross negligence.
3. Delay or Absence of Personal Physiotherapy Feedback / Info
DigiCorpus Ltd. is not liable for any damages or losses to the buyer / third party as a result of the delay or default of personal physiotherapy feedback / information unless the purchaser / third party can prove DigiCorpus Ltd. guilty of gross negligence.
DigiCorpus Ltd. is exempt from liability in cases of force majeure, i.e. non-performance of the contract due to unforeseen circumstances of causes that can not be removed or bypassed without undue sacrifice. Force majeure includes (but is not exclusive to) statutory or governmental actions, war or threat of war, riot, civil commotion, terrorism, anti-terrorism, sabotage, natural disasters, strikes, lockouts, boycotts and blockades, whether or not DigiCorpus Ltd. is a party to the conflict, and even if the conflict only affects government's functions.
DigiCorpus Ltd. is also exempt from liability for the delay or non-delivery of services in relation to personal physiotherapy feedback / information, due to the failure, disruption, interruption, delay or other errors in the transmission of data over the DigiCorpus Ltd. used for communication, computer virus , theft, destruction or unauthorized access to, or use of, the DigiCorpus Ltd. computers or those of the DigiCorpus Ltd. used for communication.
4. Direct and Indirect Effects
DigiCorpus Ltd. is not liable for direct or indirect losses, including lost profits and loss of production or damage of any kind that may be attributed to the application of the DigiCorpus ApS services provided, including information from DigiCorpus Ltd.'s website.
5. Cost of Data Traffic
Buyer must expect a running cost of data traffic via, for example. mobile broadband. The current price is DKK 49 per. month. DigiCorpus Ltd. is not responsible for any price changes due to rate increases by telecommunications operators.
6. Termination
If the agreement is terminated prior to maturity, the amount already paid will not be refunded.
